{"id":9771,"date":"2026-06-29T21:23:25","date_gmt":"2026-06-29T21:23:25","guid":{"rendered":"https:\/\/www.fintechpulse8.com\/?p=9771"},"modified":"2026-06-29T21:23:25","modified_gmt":"2026-06-29T21:23:25","slug":"the-supreme-court-upholds-fed-independence-and-also-saves-u-s-debt-from-a-crisis","status":"publish","type":"post","link":"https:\/\/www.fintechpulse8.com\/?p=9771","title":{"rendered":"The Supreme Court upholds Fed independence\u2014and also saves U.S. debt from a crisis"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/fortune.com\/img-assets\/wp-content\/uploads\/2026\/06\/GettyImages-2277860098-e1782747043762.jpg?w=2048\" \/><\/p>\n<p>The Federal Reserve retains a special status in the government that shields it from interference by the White House, the Supreme Court said in a decision that has critical implications for the bond market.<\/p>\n<div>\n<p class=\"wp-block-paragraph\">Justices ruled 5\u20134 on Monday that President Donald Trump was wrong to try ousting Fed Governor Lisa Cook last August because she didn\u2019t receive due process.<\/p>\n<p class=\"wp-block-paragraph\">Trump\u2019s bid to fire her\u2014the first such attempt ever\u2014came as he was demanding the Fed lower interest rates, despite data showing inflation remained elevated, the result, in part, of his tariffs.<\/p>\n<p class=\"wp-block-paragraph\">While Fed officials can be removed \u201cfor cause,\u201d which has been interpreted to mean gross malfeasance or negligence, Cook was accused of committing mortgage fraud before joining the Fed. She has denied the charges and said she wasn\u2019t given the chance to rebut the claims. Lower courts agreed with her.<\/p>\n<p class=\"wp-block-paragraph\">\u201cUnder our precedents, Cook was entitled to notice and some opportunity to respond prior to her termination,\u201d Chief Justice John Roberts wrote.<\/p>\n<p class=\"wp-block-paragraph\">He also asserted the Trump administration\u2019s argument that a president can remove a member of the Fed \u201cat any time, for any reason, without any notice before, and without any judicial check\u201d would render the \u201cfor-cause protection into little more than at-will employment.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Protecting the Fed from the whims of a president is vital to the central bank\u2019s duty to set monetary policy free of political considerations, Roberts explained.<\/p>\n<p class=\"wp-block-paragraph\">\u201cNot only the<em>\u00a0fact<\/em>\u00a0of independence but also the\u00a0<em>appearance\u00a0<\/em>of independence is key to the Federal Reserve\u2019s design,\u201d he wrote.<\/p>\n<p class=\"wp-block-paragraph\">The Supreme Court decision on the Cook case followed a federal district judge\u2019s dismissal earlier this year of subpoenas related to a Justice Department probe into former Fed Chair Jerome Powell.<\/p>\n<p class=\"wp-block-paragraph\">That judge said the subpoenas appeared to be meant to pressure Powell into lowering interest rates or resigning. The Justice Department has suspended its investigation, but Powell said he will remain as a Fed governor until the case is fully resolved.<\/p>\n<p class=\"wp-block-paragraph\">That breaks a tradition from his predecessors, who have stepped down from the Fed board when their terms as chair expired. But Powell has been a staunch defender of Fed independence. <\/p>\n<p class=\"wp-block-paragraph\">The Fed\u2019s ability to fight inflation without outside meddling, especially if it entails painful rate hikes, underpins the bond market. If investors believed politics were influencing monetary policy, Treasuries would sell off as markets price in a greater likelihood of higher inflation that erodes fixed income.<\/p>\n<p class=\"wp-block-paragraph\">That would make them less attractive to own, reducing demand just as the federal government needs to issue a flood of fresh debt to cover massive budget deficits. Bond yields would also jump and force the government to pay more to borrow money, worsening the deficit and adding further to the $39 trillion pile of U.S. debt.<\/p>\n<p class=\"wp-block-paragraph\">In fact, the Fed\u2019s role in the bond market was cited by ratings agency S&amp;P Global when it reaffirmed the U.S. debt rating at AA+ on Friday. While much of the language was similar to S&amp;P\u2019s annual rating update from last year, it was the first one since Trump tried to fire Cook and investigate Powell.<\/p>\n<p class=\"wp-block-paragraph\">\u201cThe institutional strength and credibility of the Federal Reserve System provide the U.S. with considerable monetary policy flexibility,\u201d S&amp;P said. \u201cThe central bank has helped stabilize global financial markets time and time again. We expect the Fed to continue navigating the challenges of lowering inflation and addressing financial market vulnerabilities.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Other U.S. attributes also factored into the AA+ rating, such as the strong economy and even tariff revenue that helps offset the federal budget deficit.<\/p>\n<p class=\"wp-block-paragraph\">But the Fed\u2019s independence and the dollar\u2019s role as the world\u2019s reserve currency are pillars to the U.S. rating, according to S&amp;P.<\/p>\n<p class=\"wp-block-paragraph\">S&amp;P took away the U.S.\u2019s top AAA rating in 2011 owing to fiscal and political dysfunction.
