{"id":7836,"date":"2026-06-18T00:02:37","date_gmt":"2026-06-18T00:02:37","guid":{"rendered":"https:\/\/www.fintechpulse8.com\/?p=7836"},"modified":"2026-06-18T00:02:37","modified_gmt":"2026-06-18T00:02:37","slug":"court-action-launched-over-rafs-failure-to-pay-430-finalised-claims","status":"publish","type":"post","link":"https:\/\/www.fintechpulse8.com\/?p=7836","title":{"rendered":"Court action launched over RAF\u2019s failure to pay 430+ finalised claims"},"content":{"rendered":"<p><\/p>\n<div>\n<p>The application comes amid heightened scrutiny of the RAF\u2019s governance and accountability, following the decision by parliament\u2019s Standing Committee on Public Accounts (Scopa) to lay criminal charges against former RAF CEO Collins Letsoalo for failing to comply with a parliamentary summons.<\/p>\n<p>Against this backdrop, concerns around oversight, financial management and the consequences of non-compliance within the RAF have intensified.<\/p>\n<p>Despite these claims having been finalised, many clients remain unpaid long after the RAF\u2019s stated 180-day payment period.<\/p>\n<blockquote>\n<p>In some instances, claimants have waited more than two years for compensation that has already been agreed to or ordered by a court.<\/p>\n<\/blockquote>\n<p>The court application seeks an order compelling the RAF to provide full reasons and detailed explanations for its failure to effect payment in each matter where a settlement agreement has been concluded or a court order issued, but payment has not been made within the prescribed timeframe.<\/p>\n<p>According to de Broglio Attorneys, the matter raises serious concerns about transparency, administrative accountability and the enforceability of finalised claims within the RAF system.<\/p>\n<p>\u201cThese are not numbers on a spreadsheet. They are individuals whose lives have already been fundamentally changed by serious road accidents,\u201d says Michael de Broglio, director of de Broglio Attorneys.<\/p>\n<p>Rory Meintjies is just one of many tragic examples. At an age when most young adults are building careers and planning for the future, the 29-year-old is confined to a wheelchair and reliant on family members for daily care.<\/p>\n<p>A devastating road accident four years ago left him with a spinal cord injury and permanent paralysis from the waist down. After spending four months in hospital, he returned home to a future in which he would be unable to work, live independently or care for himself.<\/p>\n<p>While his aunt Belinda works full time to support the household, her 73-year-old mother helps care for Rory during the day. Image: Supplied<\/p>\n<\/div>\n<p>In another case, Gauteng business owner Sanet du Toit continues to live with the consequences of a serious road crash years after it occurred.<\/p>\n<p>Du Toit, who co-owns the Koi for Life koi farm, nearly died when a vehicle crossed from the opposite side of the highway and collided head-on with her car. She spent a month in intensive care and has since undergone numerous major operations.<\/p>\n<p>Her injuries have left her unable to participate in the business as she once did, forcing the family to rely on overdraft facilities and loans to keep the operation afloat.<\/p>\n<p>\u201cAs my body has suffered tremendously after numerous big operations, I have not been able to operate physically the same as I used to before the accident,\u201d she explains.<\/p>\n<p>\u201cKoi for Life has had to survive on overdrafts of around R500 000 over the past two years, as we can clearly see and feel the effect of me not actively being involved at the farm.\u201d<\/p>\n<p>\u201cOnce a matter is settled or a court order is granted, there is a legitimate expectation that payment will follow within a reasonable and defined period. Continued delays undermine that expectation and prolong hardship for people who should already have received their compensation,\u201d says de Broglio.<\/p>\n<p>The firm argues that delayed payments have a direct impact on access to ongoing medical treatment, rehabilitation, mobility aids, specialised care, home modifications and the financial stability of affected families.<\/p>\n<p>In some cases, claimants have reportedly died before receiving compensation that had already been finalised through a settlement agreement or court order.<\/p>\n<blockquote>\n<p>\u201cFamilies are left carrying the emotional and financial burden of these delays,\u201d adds de Broglio.<\/p>\n<\/blockquote>\n<p>\u201cWhere compensation has been determined by agreement or court order, there is no ambiguity about what is owed. Delays of many months and, in some cases, years, raise serious concerns about accountability and the effective administration of justice for vulnerable road accident victims.\u201d<\/p>\n<p>The firm has called for urgent engagement between all relevant stakeholders, including the RAF, the RAF board and the Department of Transport, to prioritise practical solutions that ensure finalised claims are paid within predictable and reasonable timeframes.<\/p>\n<p>\u201cOur concern is ultimately for the people affected. When a claim has been settled or a court order has been granted, the matter is concluded in law.
